What the CE mark is — and isn't

CE is a self-declaration of conformity with applicable EU directives and regulations. It is not a quality mark, it is not issued by the EU, and it is not a certificate you can 'buy'. The manufacturer (or their authorized representative in the EU) signs a Declaration of Conformity and affixes the CE mark, taking legal responsibility for the product's compliance.

The product must satisfy the relevant directives' essential requirements — for example the Low Voltage Directive, EMC Directive, Machinery Directive, RoHS, or REACH — verified through testing and technical documentation. Compliance is checked by market surveillance authorities; failure can lead to withdrawal from the EU market and fines.

Which products need CE marking

CE applies to products covered by one or more 'new approach' directives: electronics, machinery, toys, medical devices, personal protective equipment, construction products, gas appliances, and more. Some categories — food, cosmetics, pharmaceuticals, chemicals such as those covered by CLP — are excluded from CE and governed by separate regimes.

The fastest way to confirm applicability is to identify the product's directives by category and ask a testing laboratory (TÜV, SGS, Intertek, Bureau Veritas, or a notified body) for a scope assessment. Most importers discover CE requirements the hard way — at customs, where an invalid or absent declaration stops the shipment.

The conformity assessment process

The typical path: (1) identify applicable directives and harmonized standards; (2) test the product against the relevant standards; (3) prepare the technical file — design drawings, test reports, risk assessment, user instructions; (4) if a notified body is required for the product category, involve one for the assessment; (5) issue the Declaration of Conformity; (6) affix the CE mark and, where required, print the importer's and manufacturer's details on the product or packaging.

Timing depends on the category: simple self-assessment for some electronics can be done in weeks, while machinery with harmonized-standard gaps can take months and involve multiple test iterations. Budget both time and money before signing a purchase order — retrofitting compliance after shipment is always more expensive.

Common and costly mistakes

The three most expensive errors: buying a fake CE certificate (no such document exists; check the test report and the testing lab's identity), relying on the supplier's declaration without seeing the technical file, and assuming one test covers all directives the product falls under. Also note that CE is required at the point of placing on the EU market — the importer of record, not the Chinese factory, carries legal responsibility.
